{"id":8695,"date":"2024-02-07T09:41:00","date_gmt":"2024-02-07T04:11:00","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2024\/02\/07\/appeals-court-rules-trump-does-not-have-presidential-immunity\/"},"modified":"2024-02-07T09:41:00","modified_gmt":"2024-02-07T04:11:00","slug":"appeals-court-rules-trump-does-not-have-presidential-immunity","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2024\/02\/07\/appeals-court-rules-trump-does-not-have-presidential-immunity\/","title":{"rendered":"Appeals Court Rules Trump Does Not Have Presidential Immunity"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div data-td-block-uid=\"tdi_82\">\n<div class=\"tdb-block-inner td-fix-index\">\n<p>A federal appeals court ruled that Donald Trump does not have presidential immunity in the January 6 case brought against him.<\/p>\n<p>According to the US Circuit Court of Appeals for the District of Columbia, there is no basis for Trump to claim he has presidential immunity.<\/p>\n<p>\u201cWe cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter,\u201d the panel wrote, according to <a href=\"https:\/\/www.cnbc.com\/2024\/02\/06\/trump-election-case-appeals-court-denies-ex-president-immunity.html\" target=\"_blank\" rel=\"noreferrer noopener\">CNBC<\/a>.<\/p>\n<p>\u201cFor the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,\u201d they added in the opinion. \u201cBut any executive immunity that may have protected him while he served as President no longer protects him against this prosecution.\u201d<\/p>\n<p>\u201cAt bottom, former President Trump\u2019s stance would collapse our system of separated powers by placing the President beyond the reach of all three Branches,\u201d the panel wrote. \u201cPresidential immunity against federal indictment would mean that, as to the President, the Congress could not legislate, the Executive could not prosecute and the Judiciary could not review.\u201d<\/p>\n<p>It is expected that Trump will appeal the case to the Supreme Court.<\/p>\n<p>Trump Campaign spokesman Steven Cheung issued a statement after the ruling, saying, \u201cIf immunity is not granted to a President, every future President who leaves office will be immediately indicted by the opposing party.\u201d<\/p>\n<p>\u201cWithout complete immunity, a President of the United States would not be able to properly function!
