{"id":840,"date":"2023-08-22T15:19:06","date_gmt":"2023-08-22T15:19:06","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2023\/08\/22\/court-allows-alabama-to-prohibit-transgender-surgeries-and-puberty-blockers-for-minors\/"},"modified":"2023-08-22T15:19:06","modified_gmt":"2023-08-22T15:19:06","slug":"court-allows-alabama-to-prohibit-transgender-surgeries-and-puberty-blockers-for-minors","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2023\/08\/22\/court-allows-alabama-to-prohibit-transgender-surgeries-and-puberty-blockers-for-minors\/","title":{"rendered":"Court Allows Alabama to Prohibit Transgender Surgeries and Puberty Blockers for Minors"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"article_content\">\n<header>\n<div class=\"article-byline has-tools\">\n<div class=\"article-tools\"><a href=\"#cp-talk\" class=\"has-number talk-cp-255172\" data-scrollto=\".viafoura\" aria-label=\"Go to comments\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/chat-rect.svg\" alt=\"\"\/><span class=\"number\"\/><\/a><a href=\"\" class=\"js-share\" aria-label=\"Share\" id=\"share-btn\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/share-outline.svg\" alt=\"\"\/><\/a><\/div>\n<\/div>\n<\/header>\n<figure class=\"img-box align-center center\" itemscope=\"\" itemtype=\"https:\/\/schema.org\/ImageObject\"><picture width=\"760\" height=\"512\"><source type=\"image\/webp\" srcset=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/15\/00\/150058_w_760_512.webp\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/15\/00\/150058_w_760_512.jpg\" class=\"type:primaryImage\" width=\"760\" height=\"512\"\/><\/source><\/picture><figcaption class=\"caption\"><span class=\"photo-des\">Alabama state Capitol building in Montgomery, Alabama. <\/span> | <span class=\"credit\">iStocl\/wellesenterprises<\/span><\/figcaption><\/figure>\n<p>An appeals court panel has unanimously ruled to end a block on an Alabama law that bans the use of body-mutilating sex-change surgeries and experimental drugs for youth suffering from confusion about their sex.\u00a0<\/p>\n<p>In a <a href=\"https:\/\/www.alabamaag.gov\/wp-content\/uploads\/2023\/08\/08.21.23-Eknes-Tucker-Opinion.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> released Monday, the United States Court of Appeals for the 11th Circuit unanimously upheld the right of Alabama to enforce the state\u2019s Vulnerable Child Compassion and Protection Act.<\/p>\n<p>Circuit Judge Barbara Lagoa, a Trump appointee, authored the panel opinion, concluding that \u201cthe district court abused its discretion in issuing this preliminary injunction because it applied the wrong standard of scrutiny.\u201d<\/p>\n<p>\u201cThe plaintiffs have not presented any authority that supports the existence of a constitutional right to \u2018treat [one\u2019s] children with transitioning medications subject to medically accepted standards,\u2019\u201d wrote Lagoa.<\/p>\n<p>\u201cBecause the district court erred by reviewing the statute under a heightened standard of scrutiny, its determination that the plaintiffs have established a substantial likelihood of success on the merits cannot stand. We therefore vacate the preliminary injunction.\u201d<\/p>\n<p>Circuit Judge Andrew L. Brasher, another Trump appointee, authored a concurring opinion, critiquing the claim that the law violates the equal protection given to people on the basis of sex.<\/p>\n<p>\u201c[A]n injunction against the enforcement of Alabama\u2019s law under equal-protection principles will not equalize burdens or benefits between girls and boys,\u201d wrote Brasher.<\/p>\n<p>\u201cIt will not require the government to treat boys and girls the same. It will merely force Alabama to <em>either<\/em> ban puberty blockers and [opposite-sex] hormones for all purposes or allow them for all purposes.\u201d<\/p>\n<p>Alabama Attorney General Steve Marshall issued a <a href=\"https:\/\/www.alabamaag.gov\/alabama-attorney-general-marshall-victorious-in-eleventh-circuit-court-of-appeals-injunction-against-law-protecting-children-from-experimental-sex-modification-procedures-to-be-vacated\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> on Monday celebrating the appeals court panel decision, considering a victory for defending the wellbeing of children.<\/p>\n<p>\u201cThe Eleventh Circuit reinforced that the State has the authority to safeguard the physical and psychological wellbeing of minors, even if the United States Attorney General and radical interest groups disapprove,\u201d stated Marshall.<\/p>\n<p>\u201cAlabama takes this responsibility seriously by forbidding doctors from prescribing minors sex-modification procedures that have permanent and often irreversible effects. This is a significant victory for our country, for children, and for common sense.\u201d<\/p>\n<p>The families challenging the law are being represented by the Human Rights Campaign, GLBTQ Legal Advocates &amp; Defenders, the National Center for Lesbian Rights, the Southern Poverty Law Center, King &amp; Spalding LLP and Lightfoot, Franklin &amp; White LLC.<\/p>\n<p>In a <a href=\"https:\/\/www.hrc.org\/press-releases\/statement-on-11th-circuit-ruling-reversing-injunction-on-alabama-transgender-healthcare-ban\" target=\"_blank\" rel=\"noopener\">joint statement<\/a> released Monday, the LGBT advocacy groups denounced what they called \u201ca deeply disappointing decision\u201d in which the plaintiffs were \u201cdevastated by this decision.\u201d<\/p>\n<p>\u201cWhile this is a setback, we are confident that it is only a temporary one. Every federal district court that has heard the evidence presented in these cases has come to the same conclusion: these medical treatments are safe, effective, and lifesaving for some youth, and there is no legitimate reason to ban them,\u201d they stated.<\/p>\n<p>\u201cParents, not the government, are best situated to make these medical decisions for their children. These laws are a shocking example of government overreach and a jarring intrusion into private family decisions. This case is far from over, and we will continue to aggressively seek legal protection for these families.\u201d<\/p>\n<p>In April of last year, Alabama Gov.
