The presentment will next be sent to the Court for the Trial of a Bishop, according to ACNA.<\/p>\n<p>A public declaration Tuesday states that in the judgment of at least two-thirds of the Board of Inquiry, there is probable cause to bring Ruch to trial for violations of <a href=\"https:\/\/anglicanchurch.net\/wp-content\/uploads\/2020\/02\/CURRENT-C-and-C-2019.pdf\" target=\"_blank\" rel=\"noopener\">Canon IV.2.3, Canon IV.2.4, and Canon IV.2.9<\/a>. Specifically, he is being tried for violating ordination vows, \u201cconduct giving just cause for scandal or offense, including the abuse of ecclesiastical power\u201d and for \u201cdisobedience, or willful contravention\u201d of denominational bylaws.<\/p>\n<p>In a <a href=\"https:\/\/midwestanglican.org\/letter-from-bishop-stewart-2\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>, Ruch said he is \u201cthankful\u201d and \u201crelieved that there will be an occasion to hear all sides and gain some resolution after two years.\u201d<\/p>\n<p>\u201cPlease bring your concerns to your clergy, vestry, or parish councils, who will offer care in every way possible. I am so thankful for your faithfulness in praying for healing for all and for the Lord\u2019s leading during this painful season,\u201d Ruch stated.<\/p>\n<p>\u201cPlease pray for everyone involved in these proceedings. And pray that, in the meantime, our diocesan churches receive God\u2019s blessing as they continue to carry out their Gospel work.\u201d<\/p>\n<p>In June 2021, ACNA was informed that there had been\u00a0an \u201c<a href=\"https:\/\/anglicanchurch.net\/firm-hired-to-investigate-allegations-of-misconduct-in-upper-midwest\/\" target=\"_blank\" rel=\"noopener\">erosion of trust<\/a> in the Diocese of the Upper Midwest due to allegations that the Diocese mishandled accusations of sexual misconduct.\u201d<\/p>\n<p>One prominent example was ACNA lay leader Mark Rivera, who was arrested and eventually <a href=\"https:\/\/www.cbsnews.com\/chicago\/news\/ex-pastor-sexual-assault-goddaughter\/\" target=\"_blank\" rel=\"noopener\">found guilty<\/a> of multiple charges of sexual assault, including against his 9-year-old goddaughter.<\/p>\n<p>Issues over how the diocese handled the allegations led to the creation of <a href=\"https:\/\/www.acnatoo.org\/about-us\" target=\"_blank\" rel=\"noopener\">ACNAtoo<\/a>, a watchdog group centered on abuse survivors and their advocates within the denomination.<\/p>\n<p>Last year, ACNA hired Husch Blackwell LLP to investigate the Upper Midwest Diocese, with the law firm <a href=\"https:\/\/www.dropbox.com\/s\/hr74mfwi33e37yn\/HB%20Report%20for%20Public%20Release_Redacted.pdf?dl=0\" target=\"_blank\" rel=\"noopener\">releasing a report <\/a>last September detailing allegations of sexual misconduct and how the claims were handled.<\/p>\n<p>Regarding allegations against Rivera, the report said that Ruch believed that it was a matter for law enforcement \u201cto uncover whether there was criminal conduct or not\u201d and that the church was there to provide pastoral care to both the alleged victim and alleged perpetrator.<\/p>\n<p>Last October, 16 months after Ruch voluntarily went on a leave of absence in response to the concerns over his handling of allegations, the bishop <a href=\"https:\/\/midwestanglican.org\/important-letter-from-bp-stewart\/\" target=\"_blank\" rel=\"noopener\">returned<\/a> to his office, with Bishop Martyn Minns serving in a supervisory role at the regional body.<\/p>\n<p>In June, ACNA Archbishop Foley Beach <a href=\"https:\/\/anglicanchurch.net\/update-on-the-diocese-of-the-upper-midwest-june-7-2023\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> that Ruch had \u201cmade a secret appeal to the Provincial Tribunal\u201d in January to try and declare a presentment made against him by multiple bishops invalid.<\/p>\n<p>\u201cThe Tribunal failed to give proper notice to me, the Presenting Bishops, or the Provincial Chancellors.
