{"id":2478,"date":"2023-10-06T00:21:23","date_gmt":"2023-10-06T00:21:23","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2023\/10\/06\/air-force-reservist-files-lawsuit-over-disciplinary-measures-for-personal-remarks-made-outside-service-hours\/"},"modified":"2023-10-06T00:21:23","modified_gmt":"2023-10-06T00:21:23","slug":"air-force-reservist-files-lawsuit-over-disciplinary-measures-for-personal-remarks-made-outside-service-hours","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2023\/10\/06\/air-force-reservist-files-lawsuit-over-disciplinary-measures-for-personal-remarks-made-outside-service-hours\/","title":{"rendered":"Air Force Reservist Files Lawsuit over Disciplinary Measures for Personal Remarks Made Outside Service Hours"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"article_content\">\n<header>\n<div class=\"article-byline has-tools\">\n<div class=\"article-tools\"><a href=\"#cp-talk\" class=\"has-number talk-cp-255851\" data-scrollto=\".viafoura\" aria-label=\"Go to comments\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/chat-rect.svg\" alt=\"\"\/><span class=\"number\"\/><\/a><a href=\"\" class=\"js-share\" aria-label=\"Share\" id=\"share-btn\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/share-outline.svg\" alt=\"\"\/><\/a><\/div>\n<\/div>\n<\/header>\n<figure class=\"img-box align-center center\" itemscope=\"\" itemtype=\"https:\/\/schema.org\/ImageObject\"><picture width=\"760\" height=\"507\"><source type=\"image\/webp\" srcset=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/14\/64\/146404_w_760_507.webp\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/14\/64\/146404_w_760_507.jpg\" class=\"type:primaryImage\" width=\"760\" height=\"507\"\/><\/source><\/picture><figcaption class=\"caption\"><span class=\"photo-des\">Cadets stand near their seats during the 2019 graduation ceremony at the United States Air Force Academy on May 30, 2019, in Colorado Springs, Colorado.<\/span> | <span class=\"credit\">CHET STRANGE\/AFP via Getty Images<\/span><\/figcaption><\/figure>\n<p>A member of the U.S. Armed Forces is taking legal action against the Department of Defense and other officials after he was disciplined for remarks he made while in uniform at a private ceremony.<\/p>\n<p>U.S. Air Force Reserve Jace Yarbrough, who had previously served on active duty and is an attorney in his civilian life, received a letter of admonishment\u00a0for giving remarks while off duty at a retirement ceremony in 2021 that some deemed political in nature.<\/p>\n<p>A <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2023\/10\/Jace_2023-10-03_Doc-1_Complaint-Filed10_Redacted.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> filed Tuesday on behalf of Yarbrough in the U.S. District Court for the Eastern District of Texas, Sherman Division accuses military officials of violating the reservists&#8217; rights.<\/p>\n<p>&#8220;This case arises from Defendants&#8217; decision to take adverse, disciplinary action against Plaintiff, Mr. Jace Yarbrough, solely for his private religious belief and private speech on matters of public concern,&#8221; reads the complaint.<\/p>\n<p>&#8220;Despite multiple administrative appeals up the chain of command, Defendants refused to rescind the discipline, which will continue to have a significant negative impact on Mr. Yarbrough&#8217;s military and civilian careers.&#8221;<\/p>\n<p>In June 2021, Yarbrough gave a speech while in uniform at a military retirement ceremony held at the Battleship Missouri Memorial in Pearl Harbor, Hawaii, in which he spoke about his faith and his concern about politics in the military.<\/p>\n<p>Yarbrough was concerned about a &#8220;culture war&#8221; within the Armed Forces and said &#8220;men can&#8217;t birth babies&#8221; and that &#8220;boys should not be allowed in girls&#8217; locker rooms.&#8221;<\/p>\n<p>A member of the U.S. Navy who was present for the speech filed a complaint against Yarbrough, with the reservist receiving an admonishment letter reprimanding him for his remarks in August 2021.\u00a0<\/p>\n<p>&#8220;The LOA condemned specific remarks, including his references to &#8216;radical political<br \/>factions,&#8217; &#8216;how the military is fostering a culture of &#8216;incompetence and cowardice,\u2019 and<br \/>&#8216;DoD-wide extremism training as a \u2018thinly veiled flex of political power,'&#8221; the complaint reads.<\/p>\n<p>&#8220;The LOA stated that Mr. Yarbrough\u2019s expressed viewpoints were improper because<br \/>&#8216;[m]ilitary members are to remain apolitical and must respect the chain of command.'&#8221;<\/p>\n<p>Attached to the letter of admonishment were witness statements. One witness noted that Yarbrough&#8217;s &#8220;personal\/religious views seemed to be in conflict with the rights of the LGBTQ community.&#8221; Meanwhile, another stated that &#8220;his message had a religious tone to it.&#8221;<\/p>\n<p>Yarbrough is represented by the First Liberty Institute, the law firm Winston &amp; Strawn, the Ave Maria School of Law Veterans and Servicemembers Law Clinic.<\/p>\n<p>Antony Kolenc, director of the Veterans and Servicemembers Law Clinic, said in a <a href=\"https:\/\/firstliberty.org\/media\/department-of-the-air-force-sued-for-violating-reservists-free-speech-and-religious-exercise-rights-for-off-duty-remarks\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> that &#8220;this cause is central to our mission&#8221; of &#8220;preserving religious liberty.&#8221;<\/p>\n<p>&#8220;Our clinical students have been inspired by Jace&#8217;s courage to take a stand for the rights of military reservists. We hope this case will help stop the erosion of First Amendment protections in the U.S. Armed Forces,&#8221; stated Kolenc.<\/p>\n<p>The U.S. Armed Forces has long limited the extent to which military personnel can wear uniforms and be involved in speech or events that are considered political in nature.<\/p>\n<p>According to a <a href=\"https:\/\/www.esd.whs.mil\/Portals\/54\/Documents\/DD\/issuances\/dodd\/134410p.pdf\" target=\"_blank\" rel=\"noopener\">2008 Defense Department directive<\/a>, &#8220;members on active duty should not engage in partisan political activity&#8221; and &#8220;members not on active duty should avoid inferences that their political activities imply or appear to imply official sponsorship, approval, or endorsement.&#8221;<\/p>\n<p>The directive states that a military member cannot &#8220;Wear a uniform or use any Government property or facilities&#8221; when &#8220;taking part in local nonpartisan political activity.&#8221;<\/p>\n<p>Capt.
