{"id":2352,"date":"2023-10-03T09:13:49","date_gmt":"2023-10-03T09:13:49","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2023\/10\/03\/appeals-court-approves-idahos-enforcement-of-a-near-total-abortion-ban\/"},"modified":"2023-10-03T09:13:49","modified_gmt":"2023-10-03T09:13:49","slug":"appeals-court-approves-idahos-enforcement-of-a-near-total-abortion-ban","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2023\/10\/03\/appeals-court-approves-idahos-enforcement-of-a-near-total-abortion-ban\/","title":{"rendered":"Appeals court approves Idaho&#8217;s enforcement of a &#8216;near-total&#8217; abortion ban"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"article_content\">\n<header>\n<div class=\"article-byline has-tools\">\n<div class=\"article-tools\"><a href=\"#cp-talk\" class=\"has-number talk-cp-255807\" data-scrollto=\".viafoura\" aria-label=\"Go to comments\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/chat-rect.svg\" alt=\"\"\/><span class=\"number\"\/><\/a><a href=\"\" class=\"js-share\" aria-label=\"Share\" id=\"share-btn\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/share-outline.svg\" alt=\"\"\/><\/a><\/div>\n<\/div>\n<\/header>\n<figure class=\"img-box align-center center\" itemscope=\"\" itemtype=\"https:\/\/schema.org\/ImageObject\"><picture width=\"760\" height=\"507\"><source type=\"image\/webp\" srcset=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/14\/26\/142603_w_760_507.webp\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/14\/26\/142603_w_760_507.jpg\" class=\"type:primaryImage\" width=\"760\" height=\"507\"\/><\/source><\/picture><figcaption class=\"caption\"><span class=\"photo-des\">Attorney General Merrick Garland speaks at the Department of Justice on April 21, 2021, in Washington, D.C. <\/span> | <span class=\"credit\">AFP via Getty Images\/Andrew Harnik<\/span><\/figcaption><\/figure>\n<p>Idaho can enforce a law that bans most abortions while the measure is currently facing a legal challenge, a federal appeals court panel has ruled, handing the Biden administration a temporary defeat in its effort to overturn the state law.\u00a0\u00a0<\/p>\n<p>A three-judge panel of the 9th U.S. Circuit Court of Appeals <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2023\/09\/united-states-vs-idaho-ninth-circuit.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> last Thursday that Idaho can enforce its <a href=\"https:\/\/www.christianpost.com\/news\/idaho-governor-signs-bill-banning-most-abortions-if-roe-is-overturned.html\" target=\"_blank\" rel=\"noopener\">ban on most abortions<\/a>, known as section 622, as the law continues to face a legal challenge, overturning a lower court decision.<\/p>\n<p>Circuit Judge Lawrence VanDyke, a Donald Trump appointee, authored the panel opinion, concluding that the state law does not violate the Emergency Medical Treatment and Labor Act of 1986.\u00a0<\/p>\n<p>The U.S. Department of Justice argued that the EMTALA, which requires hospitals receiving Medicare funds to provide necessary treatment to patients who arrive at their emergency departments while experiencing a medical emergency, preempts the Iadho law in situations where an abortion is necessary stabilizing treatment for an emergency medical condition.\u00a0<\/p>\n<p>&#8220;EMTALA does not require abortions, and even if it did in some circumstances, that requirement would not directly conflict with section 622,&#8221; wrote VanDyke.<\/p>\n<p>&#8220;The federal government will not be injured by the stay of an order preliminarily enjoining enforcement of a state law that does not conflict with its own. Idaho, on the other hand, will be irreparably injured absent a stay because the preliminary injunction directly harms its sovereignty.&#8221;<\/p>\n<p>The panel opinion notes that &#8220;even assuming that EMTALA did require abortions in certain, limited circumstances, it would not require abortions that are punishable by section 622.&#8221;<\/p>\n<p>Idaho Attorney General Ra\u00fal R. Labrador said in a <a href=\"https:\/\/www.ag.idaho.gov\/newsroom\/ninth-circuit-sides-with-idaho-and-deals-blow-to-united-states-abortion-lawsuit\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> that &#8220;the Biden administration baselessly sued the State of Idaho.&#8221;<\/p>\n<p>&#8220;I&#8217;m proud of the work my team has done, including collaborating with the legislature&#8217;s counsel, to ensure Idaho&#8217;s sensible law continues to save the lives of babies and provides medical professionals with the ability to exercise their judgment to assist women who need emergency care,&#8221; stated Labrador.<\/p>\n<p>&#8220;We are encouraged by the Ninth Circuit panel&#8217;s decision. Our office acknowledges that this battle is not yet resolved, and we will persist in safeguarding Idaho&#8217;s sovereignty against federal overreach.&#8221;<\/p>\n<p>In 2020, Idaho passed an abortion ban slated to take effect once the U.S. Supreme Court overturned <em>Roe v. Wade<\/em>, which it did in June 2022 with the <a href=\"https:\/\/www.christianpost.com\/news\/supreme-court-overturns-roe-v-wade-in-abortion-ruling.html\" target=\"_blank\" rel=\"noopener\"><em>Dobbs v.
