Jeremy Bratt<\/span><\/figcaption><\/figure>\n<p>Anthony Stephens, a married former pastor of <a href=\"https:\/\/www.oursaviourcroton.org\/\" target=\"_blank\" rel=\"noopener\">Our Savior Lutheran Church in Croton-on-Hudson<\/a> who is also a licensed mental health counselor and attorney, has filed a lawsuit against the Metropolitan New York Synod of the Evangelical Lutheran Church in America after he was defrocked following what he argues is a protected confession of infidelity to a colleague minister.<\/p>\n<p>The <a href=\"https:\/\/s3.documentcloud.org\/documents\/23980209\/stephens-complaint.pdf\" target=\"_blank\" rel=\"noopener\">42-page lawsuit filed in May<\/a> names the MNY Synod, the synod\u2019s leader, Bishop Paul T. Egensteiner; the Rev. Christopher S. Mietlowski, assistant to the bishop; Gayle Ruege, Egensteiner\u2019s executive assistant; and Andrew M. L. Dietsche, bishop of the Episcopal Diocese of New York of the Episcopal Church (USA), as defendants.<\/p>\n<p>The MNYS responded to Stephens\u2019 lawsuit on Friday with a <a href=\"https:\/\/s3.documentcloud.org\/documents\/23980427\/church-motion-to-dismiss.pdf\" target=\"_blank\" rel=\"noopener\">29-page motion to dismiss<\/a>, arguing in part that he \u201ccannot legitimately state any of his common law and tort-based claims based on the MNY Synod Council\u2019s ecclesiastical decision\u201d to defrock him.<\/p>\n<p>Lawyers for the synod argued that guidelines adopted by the ELCA Church Council, \u201cexpressly prohibit a rostered minister from engaging in infidelity or adultery, which the ELCA defines as \u2018a romantic or sexual relationship with someone other than one\u2019s spouse or partner,\u2019 and \u2018voluntary sexual intercourse between a married person and someone other than that person\u2019s current spouse,\u2019 respectively.\u201d<\/p>\n<p>\u201cThese ELCA Guidelines for Discipline also expressly provide that \u2018Rostered ministers who abuse the trust placed in them by engaging in infidelity, adultery, promiscuity, or sexual abuse of another are engaging in conduct incompatible with the character of the ministerial office,\u2019\u201d the synod\u2019s attorneys added.<\/p>\n<p>The ELCA, which is the largest Lutheran church body in the United States, <a href=\"https:\/\/www.elca.org\/lgbtq\" target=\"_blank\" rel=\"noopener\">also allows same-sex marriages<\/a> and ordains same-sex clergy.<\/p>\n<p>Stephens did not immediately respond to a request for comment from The Christian Post Tuesday, but he argues in his complaint against the defendants that when he confessed his infidelity to Mietlowski on a call on or around Nov. 14, 2022, he was assured that his confession would be kept in confidence. He said this assurance was given before the confession as well as after.<\/p>\n<p>Within 24 hours of that \u201cguarantee\u201d of confidentiality, however, Stephens alleges that Mietlowski reported him to Egensteiner \u201cin flagrant violation of his guarantees.\u201d Egensteiner allegedly then told Stephens\u2019 wife, who is also a minister in the church, about his confession.<\/p>\n<p>\u201cEgensteiner called Plaintiff&#8217;s spouse, The Reverend Lisa M. Stephens, and relying on the privileged information, which Plaintiff had in no way authorized Mietlowski to disclose and had the assurance from Mietlowski that he would not disclose, and, knowing that the material divulged was protected, carried on a conversation with Reverend Stephens on the basis of this information,\u201d Stephens\u2019 suit says. \u201cImmediately thereafter Reverend Stephens called Plaintiff and noted dryly, in sum and substance, \u2018Chris&#8217;s (Mietlowski) idea of confidentiality is obviously very different to yours.\u2019\u201d<\/p>\n<p>Among other things, Stephens contends that he was discriminated against, and his civil rights were violated because ministers who are women, members of the LGBT community, and non-white ministers who had similar failures were not treated as harshly as he was.<\/p>\n<p>Stephens\u2019 complaint states:\u00a0<\/p>\n<blockquote>\n<p>Plaintiff is aware, because he has been in MNYS since 2000, and is a psychotherapist in a Lutheran sponsored agency practicing in the MNYS environs, of females in analogous predicaments who have been treated differently by MNYS.<\/p>\n<p>Plaintiff is aware, because he has been in MNYS since 2000, and is a psychotherapist in a Lutheran sponsored agency practicing in the MNYS environs, of gay and lesbian clergy in analogous predicaments who have been treated differently by MNYS. Plaintiff is not LGBTQIA+, even though as a military chaplain, combat veteran, clergyman, therapist, and attorney is recognized as an LGBT ally.<\/p>\n<p>Plaintiff is aware, because he has been in MNYS since 2000, and is a psychotherapist in a Lutheran sponsored agency practicing in the MNYS environs, of persons of color in analogous predicaments who have been treated differently by MNYS.<\/p>\n<\/blockquote>\n<p>Lawyers for the MNYS charged that Stephens was on the ELCA roster of ministers from 2002 to 2016 when he served as pastor at Our Savior Lutheran Church. When he left that church, they said he served as a chaplain for the New York National Guard from September 1, 2016, through June 2022.<\/p>\n<p>On March 20, 2023, Stephens then informed the MNY Synod that he was \u201chonorably discharged\u201d from that National Guard chaplaincy which was \u201cfully processed last month.\u201d The MNYS charged that because he had no \u201cregularly issued letter of call,\u201d at the end of his chaplaincy, he needed to be endorsed by the synod\u2019s bishop to get on the roster of ELCA ministers again through a process known as \u201cOn Leave from Call.\u201d<\/p>\n<p>Stephens, according to church officials, requested that endorsement on March 20.
