{"id":1714,"date":"2023-09-15T15:55:52","date_gmt":"2023-09-15T15:55:52","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2023\/09\/15\/catholic-bookstore-granted-exemption-from-lgbt-nondiscrimination-law-by-city\/"},"modified":"2023-09-15T15:55:52","modified_gmt":"2023-09-15T15:55:52","slug":"catholic-bookstore-granted-exemption-from-lgbt-nondiscrimination-law-by-city","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2023\/09\/15\/catholic-bookstore-granted-exemption-from-lgbt-nondiscrimination-law-by-city\/","title":{"rendered":"Catholic Bookstore Granted Exemption from LGBT Nondiscrimination Law by City"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"article_content\">\n<header>\n<div class=\"article-byline has-tools\">\n<div class=\"article-tools\"><a href=\"#cp-talk\" class=\"has-number talk-cp-255522\" data-scrollto=\".viafoura\" aria-label=\"Go to comments\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/chat-rect.svg\" alt=\"\"\/><span class=\"number\"\/><\/a><a href=\"\" class=\"js-share\" aria-label=\"Share\" id=\"share-btn\"><img decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/assets\/img\/icon\/share-outline.svg\" alt=\"\"\/><\/a><\/div>\n<\/div>\n<\/header>\n<figure class=\"img-box align-center center\" itemscope=\"\" itemtype=\"https:\/\/schema.org\/ImageObject\"><picture width=\"760\" height=\"507\"><source type=\"image\/webp\" srcset=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/15\/03\/150333_w_760_507.webp\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn.christianpost.com\/images\/cache\/image\/15\/03\/150333_w_760_507.jpg\" class=\"type:primaryImage\" width=\"760\" height=\"507\"\/><\/source><\/picture><figcaption class=\"caption\"><span class=\"photo-des\">Getty Images<\/span><\/figcaption><\/figure>\n<p>The city of Jacksonville, Florida, has agreed to exempt a Catholic bookstore from an LGBT nondiscrimination law, thereby enabling the establishment to operate in accordance with its religious beliefs about gender and sexuality.\u00a0<\/p>\n<p>Last Thursday, the city of Jacksonville and Queen of Angels Catholic Bookstore <a href=\"https:\/\/adflegal.org\/press-release\/catholic-bookstore-now-free-speak-operate-consistent-beliefs\" target=\"_blank\" rel=\"noopener\">settled<\/a> a <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/QueenOfAngelsCatholicStoreComplaint.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> that focused on whether or not the religious business had to abide by city law regarding discrimination on the basis of sexual orientation and gender identity even though doing so would violate its deeply held religious beliefs.\u00a0<\/p>\n<p>Under the terms of the settlement, the United States District Court for the Middle District of Florida declared Queen of Angels a religious organization that was exempt from Jacksonville\u2019s law requiring businesses to adhere to nondiscrimination on the basis of sexual orientation and gender identity.\u00a0<\/p>\n<p>Alliance Defending Freedom Senior Counsel Hal Frampton, who represented the bookstore in the litigation, elaborated on its implications for the business and its owner, Christie DeTrude, in a <a href=\"https:\/\/adfmedia.org\/case\/queen-angels-catholic-bookstore-v-city-jacksonville\" target=\"_blank\" rel=\"noopener\">statement<\/a>. \u201cFree speech is for everyone. All Americans should be free to say what they believe without fear of government punishment,\u201d he said. \u201cChristie gladly serves everyone, but she can\u2019t speak messages that conflict with her religious beliefs.\u201d<\/p>\n<p>\u201cJacksonville\u2019s law threatened her with costly investigations, fines, and damages if she used her store\u2019s website to communicate Catholic beliefs about gender identity and human sexuality,\u201d Frampton added. \u201cThankfully, the city has now agreed that Queen of Angels is a religious organization free to operate according to its faith.\u201d\u00a0<\/p>\n<p>As outlined in the original <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/QueenOfAngelsCatholicStoreComplaint.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> filed in February, the Jacksonville law in question seeks to \u201celiminate discriminatory practices in public accommodations.\u201d The law defines a place of public accommodation as \u201cany establishment, service, place, or building which offers, sells, or otherwise makes available to the public any good, service, facility, privilege or advantage\u201d and specifies \u201c[a]ny retail establishment\u201d as a place of public accommodation.\u00a0<\/p>\n<p>This caused Queen of Angels to conclude that it was a place of public accommodation subject to the requirements of the nondiscrimination law. Noting that Queen of Angels \u201calso operates a for-profit website where it offers and sells goods to the public,\u201d the lawsuit stressed that \u201cthe website is also, according to Jacksonville law, a \u2018place of public accommodation\u2019 subject to the law.\u201d<\/p>\n<p>\u201cThe law contains three distinct clauses that threaten Queen of Angels\u2019 ability to speak and operate in accordance with its faith: the Privilege, Denial, and Unwelcome Clauses,\u201d the lawsuit stated. It cited \u201cQueen of Angels\u2019 practice of using only [correct and not self-declared] preferred pronouns and titles that are consistent with a customer\u2019s biological sex\u201d in accordance with a written policy that it wished to implement as a violation of all three clauses.\u00a0<\/p>\n<p>The written policy in question, as detailed in an <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/QueenOfAngelsOrder.pdf\" target=\"_blank\" rel=\"noopener\">order<\/a> handed down by U.S. District Court Judge Timothy Corrigan on July 7, asserts that \u201cowners, and employed staff, while working for the bookstore, may only use pronouns and titles that align with the biologically originating sex of the person being referenced, whether the individual is a coworker, customer, or any member of the public visiting or interacting with the bookstore.\u201d<\/p>\n<p>\u201cThe use of \u2018gender neutral\u2019 pronouns or neologisms when requested by such referenced persons as noted above, to describe an individual\u2019s identity contrary to someone\u2019s biologically originating sex, e.g. \u2018they,\u2019 \u2018ze,\u2019 or \u2018Mx.,\u2019 is also prohibited,\u201d the policy explains.<\/p>\n<p>The policy also encourages bookstore employees asked to address a trans-identified person with their self-declared chosen pronouns to \u201crespectfully and charitably decline, and instead use of a form of address that does not contradict someone\u2019s biologically originating sex, such as the person\u2019s first or last name.\u201d\u00a0<\/p>\n<p>The bookstore contended that the Jacksonville nondiscrimination law violated its First Amendment rights to free speech, association, press and assembly as well as the free exercise of religion and sought a court order forbidding the city from enforcing it against them and declaring it unconstitutional. Corrigan denied Queen of Angels\u2019 requests and granted the defendant\u2019s motion to dismiss while ordering the bookstore to file an amended complaint focusing solely on \u201cthe religious exception issue.\u201d<\/p>\n<p>Queen of Angels filed the <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/QueenOfAngelsMSJbrief.pdf\" target=\"_blank\" rel=\"noopener\">amended complaint<\/a> on July 28. The Sept. 7 settlement resolves the legal dispute at the center of the complaint, which details how the bookstore meets the definition of a religious organization.\u00a0<\/p>\n<div class=\"article_credit\">\n<p>Ryan Foley is a reporter for The Christian Post.
