{"id":13497,"date":"2024-03-11T06:13:10","date_gmt":"2024-03-11T00:43:10","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2024\/03\/11\/new-hampshire-town-demands-site-review-of-pastors-house-gathering\/"},"modified":"2024-03-11T06:13:10","modified_gmt":"2024-03-11T00:43:10","slug":"new-hampshire-town-demands-site-review-of-pastors-house-gathering","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2024\/03\/11\/new-hampshire-town-demands-site-review-of-pastors-house-gathering\/","title":{"rendered":"New Hampshire Town Demands Site Review of Pastor&#8217;s House Gathering"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>First Liberty Institute filed a request for a <a href=\"https:\/\/firstliberty.org\/media\/pastor-hosting-religious-gatherings-in-home-responds-to-towns-legal-threats\/\" target=\"_blank\" rel=\"noreferrer noopener\">preliminary injunction<\/a> against the town of Weare, New Hampshire, claiming it violated the law by mandating a site review plan before a pastor could use his home for a religious gathering.<\/p>\n<p>\u201cHundreds of thousands of Americans meet every day in homes for prayer meetings, Bible studies, book clubs, card games, and other gatherings. Why would Weare city officials demand this small church stop meeting in the pastor\u2019s home, but ignore Super Bowl parties and political gatherings?\u201d asked Senior Counsel for First Liberty Institute Jeremy Dys. \u201cSince the day the First Amendment became law all people of faith have been granted the right to worship and pray in their home with like-minded people.\u201d<\/p>\n<p>\u201cIn the United States, the tradition of using individual homes for religious gatherings\u2014even formal church services\u2014has garnered special solicitude under the law,\u201d said King &amp; Spalding partner Sean Royall, who is helping with the case. \u201cThe suit is about protecting that legal right for all faiths.\u201d<\/p>\n<p>Grace New England Church was founded as a home church by Pastor Howard Kaloogian.<\/p>\n<p>Kaloogian received a \u201cCease and Desist\u201d notice in October 2023 demanding that he \u201cimmediately stop any assembly regarding Grace New England Church. This Cease and Desist will remain in effect until a site plan is submitted, reviewed and there is a decision made by the Town Planning Board.\u201d<\/p>\n<p>First Liberty sent a <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2024\/02\/10-26-23-Ltr-to-Weare-re-Cease-and-Desist310.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">response letter<\/a> to zoning officer Tony Sawyer, saying the First Amendment\u2019s free exercise clause is \u201cinviolate in one\u2019s home and cannot be dismissed at the request of a town\u2019s zoning officer.\u201d<\/p>\n<p>\u201cYour Cease and Desist letter, on its face, targets religious speech, expression, and assembly, but leaves comparable secular activity untouched,\u201d First Liberty wrote, adding, \u201cJust as it would be ludicrous for the Town of Weare to impose a \u2018Cease and Desist\u2019 upon the assembly of its citizens at someone\u2019s home for a birthday party for a 10-year old with his friends, a neighborhood Super Bowl party, or a gathering of local residents to read the latest New York Times bestseller as a part of its weekly book club, so it is equally unjustifiable under the First Amendment for the Town of Weare to insist that Pastor Kaloogian, and others, desist from religious assembly in his home.\u201d<\/p>\n<p>First Liberty\u2019s request for a preliminary injunction <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2024\/03\/024-1-Memo-of-Law.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>, \u201cPastor Kaloogian moved to the Town in 2015. His home, situated on a spacious five-acres of land, consists of two main buildings: the primary residence and a renovated barn. The barn used to be a woodshop and party barn\u2014well-known in the community for hosting acclaimed parties from the previous property owner\u2014but has since undergone significant renovations. Now, the renovated barn consists of pews, a pulpit, an insulated ceiling, and an upgraded heating system.
