{"id":12783,"date":"2024-03-06T05:58:39","date_gmt":"2024-03-06T00:28:39","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2024\/03\/06\/judge-rules-biden-admin-cannot-force-christian-employers-to-pay-for-trans-surgeries\/"},"modified":"2024-03-06T05:58:39","modified_gmt":"2024-03-06T00:28:39","slug":"judge-rules-biden-admin-cannot-force-christian-employers-to-pay-for-trans-surgeries","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2024\/03\/06\/judge-rules-biden-admin-cannot-force-christian-employers-to-pay-for-trans-surgeries\/","title":{"rendered":"Judge Rules Biden Admin Cannot Force Christian Employers to Pay for Trans Surgeries"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div data-td-block-uid=\"tdi_82\">\n<div class=\"tdb-block-inner td-fix-index\">\n<p>Judge Daniel Traynor for the U.S. District Court for the District of North Dakota ruled that the Christian Employers Alliance (CEA) is protected from providing \u201cgender transition services,\u201d citing religious liberty.<\/p>\n<p>CEA filed a lawsuit against the Equal Employment Opportunity Commission (EEOC) in 2021 over two mandates requiring religious employers to provide health insurance covering transgender surgeries and forcing physicians holding religious views to perform sex-change surgeries.<\/p>\n<p>The lawsuit also challenged the U.S. Department of Health and Human Services\u2019 (HHS) \u201creinterpretation of \u2018sex\u2019 in federal law to include gender identity, thereby forcing religious healthcare providers to physically perform or facilitate gender transition surgeries and procedures, contrary to their deeply held beliefs,\u201d according to a 2021 press release from <a href=\"https:\/\/adflegal.org\/press-release\/christian-employers-ask-protection-against-biden-gender-transition-mandates\" target=\"_blank\" rel=\"noreferrer noopener\">Alliance Defending Freedom<\/a> (ADF).<\/p>\n<p>The judge ruled against the EEOC and HHS, <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/ChristianEmployersAllianceOrderSummaryJudgment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">writing<\/a> that CEA\u2019s \u201creligious beliefs are substantially burdened by the monetary penalties it faces for refusing to violate its beliefs.\u201d<\/p>\n<p>\u201cCEA\u2019s sincerely held religious belief is that male and female are immutable realities defined by biological sex and that gender reassignment is contrary to Christian Values,\u201d Traynor wrote. \u201cAs a result, performing or providing health care coverage for gender transition services under the EEOC and HHS coverage mandates impinges upon CEA\u2019s beliefs. CEA must either comply with the EEOC and HHS mandates by violating their sincerely held religious beliefs or else face harsh consequences like paying fines and facing civil liability.\u201d<\/p>\n<p>ADF Senior Counsel and Director of Regulatory Practice Matt Bowman said in a <a href=\"https:\/\/adfmedia.org\/case\/christian-employers-alliance-v-us-equal-employment-opportunity-commission\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>, \u201cAll employers and healthcare providers, including those in the Christian Employers Alliance, have the constitutionally protected freedom to conduct their business and render treatment in a manner consistent with their deeply held religious beliefs.\u201d<\/p>\n<p>\u201cThe employers we represent believe that God purposefully created humans as either male or female, and so it would violate their religious beliefs to pay for or perform life-altering medical procedures or surgeries that seek to change one\u2019s sex.
