{"id":12735,"date":"2024-03-05T21:47:53","date_gmt":"2024-03-05T16:17:53","guid":{"rendered":"https:\/\/cccfornews.com\/index.php\/2024\/03\/05\/supreme-court-unanimously-rules-states-cannot-remove-trump-from-ballot\/"},"modified":"2024-03-05T21:47:53","modified_gmt":"2024-03-05T16:17:53","slug":"supreme-court-unanimously-rules-states-cannot-remove-trump-from-ballot","status":"publish","type":"post","link":"https:\/\/cccfornews.com\/index.php\/2024\/03\/05\/supreme-court-unanimously-rules-states-cannot-remove-trump-from-ballot\/","title":{"rendered":"Supreme Court Unanimously Rules States Cannot Remove Trump from Ballot"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>In a unanimous 9-0 ruling, the Supreme Court declared that Colorado cannot remove Donald Trump from the ballot.<\/p>\n<p>\u201cThis case raises the question whether the States, in addition to Congress, may also enforce Section 3,\u201d the decision <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-719_19m2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>. \u201cWe conclude that States may disqualify persons holding or attempting to hold state office. But States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency.\u201d<\/p>\n<p>It adds that \u201cnothing in the Constitution delegates to the States any power to enforce Section 3 against federal officeholders and candidates.\u201d<\/p>\n<p>The state of Colorado prohibited Trump from being on the ballot over Section 3 of the 14th Amendment, the \u201cinsurrection clause,\u201d although Trump was never charged with engaging in an \u201cinsurrection\u201d following the events of January 6, 2021.<\/p>\n<p>Following the decision, Trump wrote on Truth Social, \u201cBIG WIN FOR AMERICA!!!\u201d<\/p>\n<p><iframe src=\"https:\/\/truthsocial.com\/@realDonaldTrump\/112038026037364851\/embed\" class=\"truthsocial-embed\" style=\"max-width: 100%; border: 0\" width=\"600\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Liberal justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown-Jackson issued a concurring opinion in the decision, writing, \u201cAlthough only an individual State\u2019s action is at issue here, the majority opines on which federal actors can enforce Section 3, and how they must do so. The majority announces that a disqualification for insurrection can occur only when Congress enacts a particular kind of legislation pursuant to Section 5 of the Fourteenth Amendment.\u201d<\/p>\n<p>They believed the majority \u201cgoes beyond the necessities of the case,\u201d however. <\/p>\n<p>\u201cToday, the majority goes beyond the necessities of this case to limit how Section 3 can bar an oathbreaking insurrectionist from becoming President. Although we agree that Colorado cannot enforce Section 3, we protest the majority\u2019s effort to use this case to define the limits of federal enforcement of that provision,\u201d they wrote. \u201cBecause we would decide only the issue before us, we concur only in the judgment.\u201d<\/p>\n<p>Justice Amy Coney Barrett wrote, \u201cIn my judgment, this is not the time to amplify disagreement with stridency. The Court has settled a politically charged issue in the volatile season of a Presidential election. Particularly in this circumstance, writings on the Court should turn the national temperature down, not up.\u201d<\/p>\n<p>\u201cFor present purposes, our differences are far less important than our unanimity: All nine Justices agree on the outcome of this case,\u201d she continued. \u201cThat is the message Americans should take home.\u201d<\/p>\n<p>Colorado Secretary of State Jena Griswold announced that she is \u201cdisappointed\u201d in the ruling.<\/p>\n<p>\u201cI am disappointed in the U.S. Supreme Court\u2019s decision stripping states of the authority to enforce Section 3 of the 14th Amendment for federal candidates,\u201d she wrote on X. \u201cColorado should be able to bar oath-breaking insurrections from our ballot.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">I am disappointed in the U.S. Supreme Court\u2019s decision stripping states of the authority to enforce Section 3 of the 14th Amendment for federal candidates.
