Representative Jamie Raskin (D-MD) told CNN that Democrats are preparing legislation to remove Donald Trump from the ballot.<\/p>\n
\u201cThe, court didn\u2019t exactly disagree with it. They just said that they\u2019re not the ones to figure it out. It\u2019s not going to be a matter for judicial resolution under Section Three of the 14th Amendment, but it\u2019s up to Congress to enforce it. I disagree with that interpretation just because the other parts of the 14th Amendment are self-executing,\u201d he said. <\/p>\n
\u201cPeople can go to court and say that something violates equal protection, even if there\u2019s not a federal statute that allows them to do that. But in any event, the Supreme Court punted and said, it\u2019s up to Congress to act.\u201d<\/p>\n
\u201cAnd so I am working with a number of my colleagues, including Debbie Wasserman Schultz and Eric Swalwell, to revive legislation that we had to set up a process by which we could determine that someone who committed insurrection is disqualified by section three of the 14th Amendment and the House of Representatives already impeached Donald Trump for participating in insurrection by inciting it,\u201d Raskin continued, <\/p>\n
\u201cSo the House has already pronounced upon that, and there was also a 57 to 43 vote in the Senate. The question is whether speaker Mike Johnson would allow us to bring this to the floor of the House?\u201d<\/p>\n
Raskin\u2019s comments came<\/a> in response to the Supreme Court\u2019s unanimous ruling that Colorado cannot remove Donald Trump from the ballot.<\/p>\n \u201cThis case raises the question whether the States, in addition to Congress, may also enforce Section 3,\u201d the decision\u00a0reads<\/a>. \u201cWe conclude that States may disqualify persons holding or attempting to hold state office. But States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency.\u201d<\/p>\n It adds that \u201cnothing in the Constitution delegates to the States any power to enforce Section 3 against federal officeholders and candidates.\u201d<\/p>\n<\/div>\n<\/div>\n
