The suit requested that Langford\u2019s membership be declared void and an award for unspecified damages.<\/p>\n<p>Last Friday, Wyoming U.S. District Court Judge Alan Johnson issued an <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wyd.63248\/gov.uscourts.wyd.63248.31.0.pdf\" target=\"_blank\" rel=\"noopener\">opinion <\/a>dismissing the female students\u2019 suit on the basis that the federal court cannot interfere with Kappa Kappa Gamma\u2019s freedom of association. Johnson, appointed to the bench by former President Ronald Reagan, also contended that the sorority\u2019s bylaws do not define the term \u201cwoman.\u201d\u00a0<\/p>\n<p>\u201cWith its inquiry beginning and ending there, the court will not define a \u2018woman\u2019 today,\u201d the judge wrote.\u00a0<\/p>\n<p>\u201cThe delegate of a private, voluntary organization interpreted \u2018woman,\u2019 otherwise undefined in the nonprofit\u2019s bylaws, expansively; this Judge may not invade Kappa Kappa Gamma\u2019s freedom of expressive association and inject the circumscribed definition Plaintiffs urge,\u201d he continued.<\/p>\n<p>Kappa Kappa Gamma did not immediately respond to The Christian Post\u2019s request for comment by press time.\u00a0<\/p>\n<p>According to Kappa Kappa Gamma\u2019s\u00a0<a href=\"https:\/\/www.kappakappagamma.org\/globalassets\/resources\/general-resources\/fraternity-position-statements.pdf\" target=\"_blank\" rel=\"noopener\">bylaws<\/a>, the sorority \u201cis a private, nonprofit organization for women founded in 1870.\u201d\u00a0<\/p>\n<p>\u201cThe single-gender nature of our organization is essential to the mission and purpose of Kappa Kappa Gamma and its chapters and alumnae associations,\u201d the bylaws continue. \u201cThe right to limit membership in the Fraternity to women is protected by the U.S. Constitution.\u201d<\/p>\n<p>In a statement to <a href=\"https:\/\/www.cbsnews.com\/news\/kappa-kappa-gamma-sorority-lawsuit-block-transgender-woman-dismisses-university-of-wyoming\/\" target=\"_blank\" rel=\"noopener\">CBS News<\/a>, Cassie Craven, an attorney for the sorority girls, disagreed with the judge\u2019s ruling, asserting that the definition of a woman is not a matter of debate.\u00a0<\/p>\n<p>\u201cWomen have a biological reality that deserves to be protected and recognized and we will continue to fight for that right just as women suffragists for decades have been told that their bodies, opinions, and safety doesn\u2019t matter,\u201d Craven wrote.\u00a0<\/p>\n<p>Langford\u2019s attorney, Rachel Berkness, expressed satisfaction with the ruling and dismissed allegations that the male student has made some sorority sisters uncomfortable, saying such claims are \u201ccruel rumors.\u201d The attorney argued that such claims have been \u201cused to vilify and dehumanize members of the LGBTQIA+ community for generations.\u201d\u00a0<\/p>\n<p>In its suit, the sorority sisters described an incident involving a female member who said she noticed Langford watching her as she walked down the hall, wearing only a towel as she went to shower.\u00a0<\/p>\n<p>\u201cOther times, he has had a pillow in his lap,\u201d the lawsuit states. \u201cLangford repeatedly questioned the women about what vaginas look like, breast cup size, whether some women were considering breast reductions, and birth control.\u201d\u00a0<\/p>\n<p>The lawsuit comes amid concerns about the impact of allowing men to enter female-only spaces and the safety of women and girls.\u00a0<\/p>\n<p><a href=\"https:\/\/www.christianpost.com\/news\/trans-swimmer-lia-thomas-former-teammate-speaks-out.html?clickType=link-related-articles\" target=\"_blank\" rel=\"noopener\">Paula Scanlan<\/a>, a former teammate of trans-identified male swimmer Lia (Will) Thomas, accused the University of Pennsylvania of pressuring female swimmers to remain silent regarding their feelings about having a man on the swim team. In an interview earlier this summer with The Daily Wire&#8217;s cultural commentator and radio host Matt Walsh, Scanlan lamented that female athletes were forced to share a locker room and undress around a man.\u00a0<\/p>\n<p>Thomas, whose real name is Will, competed for three seasons on the Penn men\u2019s swim team before competing on the women\u2019s team during the 2021-&#8217;22 season. After Thomas became part of the women\u2019s team, Scanlan said she noticed many girls started changing inside the bathroom stalls, something she had never seen before there was a man on the team and in their locker room.\u00a0<\/p>\n<p>\u201cThe biggest thing was just when you\u2019re changing, and there\u2019s all of these people talking in the background, and you hear all of these women\u2019s voices, and all of [a] sudden, you hear a man\u2019s voice,\u201d Scanlan recalled. \u201cI\u2019d always kind of jump a little.\u201d\u00a0<\/p>\n<p>The female athlete competed on Penn\u2019s swim team for three seasons. According to the swimmer, the university wouldn\u2019t allow any of the girls to complain about having a man on their team and in their changing room.\u00a0<\/p>\n<p>\u201cThey said, \u2018Don\u2019t talk to the media; you will regret it. \u2026 Lia\u2019s swimming is non-negotiable,\u2019\u201d Scanlan said. \u201cAnd then they provided us with counseling services to help us be OK with Lia (Will) swimming.\u201d<\/p>\n<p>\u201cIt\u2019s frightening, and your future job is on the line and everything else you want to accomplish, so of course, it worked, and then after that point, no one would talk about it anymore,\u201d Scanlan added.<\/p>\n<div class=\"article_credit\">\n<p>Samantha Kamman is a reporter for The Christian Post.
